1. Overview
cezarskitchen.com (“Website”) is the web site maintained by Cezars Kitchen K.K. “Visitor”, refers to any party who accesses the Website. “Agreement” refers to these Terms of Use and any subsequent modification. By using the Website, accessing materials, or creating an account, you agree to be bound by these terms and conditions. Cezars Kitchen reserves the right to modify this Agreement at any time without notice to the Visitor; therefore, we request that the user review this Agreement periodically to ensure awareness of any modifications.
2. Visitor Obligations
Subject to the terms of this Agreement, Cezars Kitchen grants Visitor a limited, revocable, non-exclusive, and non-transferable right to use the Website and the materials for Visitor’s intended lawful purpose for Visitor’s personal use, but not for re-sale or other commercial purposes. Visitor is responsible for all use of Visitor’s account and for ensuring that all use of Visitor’s account complies fully with the provisions of this Agreement. Visitor shall be responsible for protecting the confidentiality of Visitor’s password(s), if any.
To the extent Visitor is permitted, pursuant to this Agreement, to share the materials with others, Visitor also agrees to be fully responsible for their complying with the terms of this Agreement. You acknowledge that if you provide any Visitor data that is untrue, inaccurate, not current, or incomplete, Cezars Kitchen has the right to suspend or terminate your account and refuse any and all current or future use of the Website.
3. Downloadable Materials
Cezars Kitchen authorizes Visitor to view and download materials from Website that are explicitly available for download but Visitor may only use those materials for personal, non-commercial use or re-sale use. Such materials include lunch menu and downloadable forms. No right, title, or interest in any Website content is transferred to Visitor, whether as result of downloading the content or otherwise.
4. Copyright and Intellectual Property
All content (which may include, without limitation, text, photos, videos, graphics, recipes, menus and documents) on the Website is the copyrighted property of Cezars Kitchen. Other than the download to the Visitor’s computer that is inherent in viewing a web page and the rights granted under section 3 (Downloadable Materials), Website content may not be copied, without prior written consent of Cezars Kitchen.
Any third-party marks and content appearing on the Website are the property of their respective owners. Visitors are not permitted to use any of these third-party marks or content without permission of these respective owners.
5. Links to Third Party Sites
The Website contains links to other websites (“Linked Sites”). The Linked Sites are not under the control of the Website, therefore, make no representations, warranties, promises, or guarantees, either express or implied, concerning the content of such Linked Sites.
6. Prohibited Conduct
Visitor expressly agrees to refrain from doing, either personally or through an agent, any of the following:
a) Use any device or other means to harvest information about other Visitors.
b) Transmit, install, upload or otherwise transfer any virus or other item or process to the Website that in any way affects the use, enjoyment, or service of the Website.
d) Modify the information, including headers, found on the Website.
e) Engage in any action which Cezars Kitchen determines is detrimental to the use and enjoyment of the Website.

7. Accuracy and Integrity of Information
Although Cezars Kitchen attempts to ensure the integrity and accurateness of the Website, we make no representations, warranties or guarantees whatsoever as to the correctness or accuracy of the Website and the Materials thereon. It is possible that the Site could include typographical errors, inaccuracies or other errors, and that unauthorized additions, deletions and alterations could be made to the Website by third parties. In the event that an inaccuracy arises, please inform us so that it can be corrected. Information contained on the Website may be changed or updated without notice. Additionally, we have no responsibility or liability for information or content posted to the Website from any non-affiliated third parties.
8. Termination of Account
Cezars Kitchen shall have the right to immediately terminate Visitor’s account in the event of any conduct by Visitor which Cezars Kitchen, in its sole discretion, considers to be unacceptable, or in the event of any breach by the Visitor of this Agreement. Allowing Visitors to register an account and granting access the Website’s customer area is for the enjoyment and sharing of local cafeteria news and events.
9. Disclaimer of Warranties and Liability
VISITOR AGREES THAT USE OF THE WEBSITE AND THE MATERIALS IS AT VISITORS OWN RISK. BECAUSE OF THE NUMBER OF POSSIBLE SOURCES OF INFORMATION AVAILABLE THROUGH THE WEBSITE, AND THE INHERENT HAZARDS AND UNCERTAINTIES OF ELECTRONIC DISTRIBUTION, THERE MAY BE DELAYS, OMISSIONS, INACCURACIES OR OTHER PROBLEMS WITH SUCH INFORMATION. THE MATERIALS ON THIS SITE ARE PROVIDED TO VISITOR “AS IS” AND WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
10. Miscellaneous
This Agreement, together with the Website’s Privacy Policy, constitutes the entire agreement of the parties concerning the subject matters thereof. The foregoing shall not limit the applicability or enforceability of any other written agreement or binding terms or conditions between Visitor and the Website. This Agreement shall be construed in accordance with the laws in Japan. If any provision of this Agreement is determined by a court of law to be illegal or unenforceable, such provision will be enforced to the maximum extent possible and the other provisions will remain effective and enforceable. All rights not expressly granted herein are reserved.
